They hate an independent judiciary and this is why this case is an attack on her, and an attack on American Institutions. They have served us well for over two hundred and seventy years, but it seems they really don't care about this.

This is what this is all about, how to destroy the independent judiciary. They hate this independence for it has prevented them from turning this country into a new fascist state.   So how we have demonstrators outside of Governor Bush's office in Tallahassee per CNN. I only can say one thing, this is a storm of his own creation and he will have to live with it.

I must also ask, why are these people so afraid of dead? My only explanation quite honestly.

So what could happen? Are we about to see some real violence? Randall Terry has implied it, when he said that there will be hell to pay if terri dies. Has the Governor of the State incited a riot?

On the legal point of view and for those of us who love democracy, what does this mean to all of us? How far will they carry their attack on an independent Judiciary? This is what this case is all about, an attack on independent Judges (most of whom were appointed by Republicans and ARE Republicans themselves.)

In a late twist, the case prompted a showdown between separate branches of government as a Pinellas County circuit judge forbade law enforcement officers from taking Schiavo into state custody under a Bush directive.



That raised the prospect of law enforcement officers charged with protecting Schiavo at her Pinellas Park hospice encountering law enforcement agents charged with removing her.



Greer asked DCF attorney Jennifer Lima-Smith whether she could guarantee Schiavo would not be taken into state custody.

``I can't tell you that won't be done. We have that capability. The statute is clear,'' Lima- Smith told Greer.

The judge said he would issue the restraining order to prevent confusion among law enforcement.

  So Judge Greer has denied an appeal from Governor Jeb Bush regarding Schiavo and Jeb is threatening to take custody AGAINST the rulings from the courts. This is one of those moments in history where we are reminded what Tyranny looks like. This is a man who no longer believes in the rule of law, and is willing to go to ANY extreme to get his way. Of course we should not be too surprised my dear readers, for we have seen this rising Tyranny since 2000.

Senate Majority Leader Bill Frist of Tennessee and Republican Sens. Rick Santorum of Pennsylvania and Mel Martinez of Florida filed a friend-of-the-court brief late Wednesday siding with Schiavo's parents.

"This is not about Terri anymore. This is all a political view," Scott Schiavo, Michael Schiavo's brother, told CNN on Thursday. "They're being bullied, actually, by these right-for-life people, basically telling them, `If you don't go our way, you won't get our votes.'"

What is sad is that the majority leader is using this as a distraction from his own ethical problems, which seem to be leading down the road of Indictment. For Senator Frist this is a Presidential run calculation and it seems he is now owned by people who are part of the Christian Recontructionist and Dominionist Movement in the United States, whose intend is to "make this a Christian Nation" under their interpretation. Oh never mind that the Founding Fathers were mostly Deists and did not consider for a minute making ANY religious faith the dominant state sponsored faith in the country.

You may wonder why did this case bring Plubius back to writing? Quite simple, what the Governor of Florida is doing should horrify any thinking American. What the House and the Senate did over the past weekend should send shivers down your collective backs. Congress cannot write a bill for one individual. The reason for this is quite simple, King George III used Parlaiment to do this on a regular basis. This led to abuses of power that led to the American Revolution. What the GOP wants to do is return us to that Tyranny and the people be damned, as they do not believe in the rule of law, or the power of the people. This is what the Terri Shiavo case is showing. Incidentally, this was part of the bread and circus the corporatist media feeds the people on a regular basis. It did not matter UNTIL they brought this case to the Halls of Congress. At that moment they engaged in a direct attack on the Judiciary, and that my dear friend is what should worry you.

  My kind friends I have not been here in a while, as life has taken me in interesting directions. Saturday though this writer saw a spectacle that reminded him of Tyranny, and the rule of those crazy with religion. I could not help but wonder what our Founding Fathers might think of us, their descendants. Here we are, at the dawn of a new century and we are one step away from Fascism. No, I will not byte my tongue any longer, what we are facing is a new dark night and a Tyranny. I do know that they have no respect for the rule of law. After all it was the President who said, “it would be so much easier if this was a Dictartorship, as long as I am the Dictator.” Now we know the truth, for Tyrants have no respect for the law, or the rule of law.
It is time for the American people to wake up to the new reality, and do something about it. Though this writer no longer has any trust that the people will see beyond the game of smoke and mirrors.   My kind friends today we sit at the moment of decision

I have spoken of the love I have for our Republican ways, and why it is important to get involved. The end of Tyranny may soon be upon us, but only if you, my kind reader, get involved. You must find time to make sure YOU are registered to vote. Many a rumor of the franchise being taken by hook or crook has occurred. I know, for a fact, that these are not rumors.

My kind reader there is more. You must make sure to read and read widely and demand accountability from our Fourth Estate. She is no longer independent or working for you. In the end, my kind reader, we need the Fairness Doctrine back in the books. We need that for the health of our very sick democracy.

My kind reader we are watching Rome burn, and it is time to take the fire hoses and pour some water on the fire. We can no longer stand by the side.

The International Red Cross and other agencies have repeatedly warned us about War Crimes at Abu Ghraib. We now know some of the details, and we have seen the pictures. Words cannot describe the horror in the faces of the men, for they are all men, who our troops have tortured and degraded. The not so distant voices from our own past are demanding to know what happened to our country. How could we go from having a moral compass that led the world, to having no compass? Where did this start? Why the lack of accountability at the highest levels?

While the President and the President’s men make excuses to Americans and the World, we the people avoid facing the ugly reality: This is the reflection in the mirror which is us. We have allowed this to happen by our inaction every step of the way. Since September Eleven the country has turned into a vindictive hell against the Other. The war on terror is over, and the enemy won. One objective of Terror is to change the country under attack into something that it is not. We are no longer the America we all grew up in, or came to as immigrants.

After September 11 we cancelled the Constitution. We have allowed those in charge to arrest and hold American Citizens without Trial, or a jury. This is the true horror of the Patriot Act, and its sequel, still in the wings: The Hamdi \ Padilla cases are not isolated from what has happened at Camp X-Ray and Abu Ghraib. They are just part of the same horrible continuum. Our cancellation of the Geneva Convention because it is quaint is also part of the problem. Lawlessness now pervades our nation, and the end justifies the means. Our humanity be damned in the process.

The collective moral compass is so much out of kilter that those few men and women who have questioned every step of the way the actions of an immoral government have been called the worst of names: Traitor.

They have been marginalized and they have not been listened to. We are told they are the crazy ones among us. They are part of a fringe. On the contrary, they are the ones among us who have held to their humanity and can empathize with those across the world, as fellow human beings.

Marginalization has gone to the extent of destroying the intellectual work of those who have taken a stand. Clear Media Channel’s destruction of the Dixie Chicks CDs makes me wonder if Albert Einstein was right. He once said that those who burn books are not far from burning people, he was refereeing to 1930s Germany. The silence in the main stream media and lack of condemnation was incredible. But it is not only the media that deserves condemnation. In fact, by our collective silence we enabled it. This led to a further degradation of American Values, such as freedom of speech and freedom of dissent.

I charge all those who have supported this without question enablers of the worst horrors any nation can ever commit.

As the President and the President’s men have to be convicted by the Senate. This will only start the cleansing of our Spirit.

  Plubius is sick to his stomach today. As Hannah Arendt has written from the mists of that other good war, Evil is banal in its nature. Evil now stares and sears our soul, with imagoes of history.

The Spanish Inquisition comes to Plubius Mind, as well as the Ghettoes of Eastern Europe during the German occupation. Where would this end? the Killing fields, this is where this train wreck was headed.

The Wall Between Church and State

In the formation of this Republic our Founding Fathers grappled with many new and revolutionary concepts. One of them was a new wall between the State, which is the Civil Authority and the Church. Many Americans in recent years have claimed that there is an attack on the United States as a Christian nation. This is supposed to be a threat on the religious beliefs of a minority under threat. Books and other media have been used to spread this fallacy, as a majority cannot be under attack. So Plubius will first explore where this wall between Church and State came from.
Imagine if you will a country where the Civilian Authority enforces Religious law. Does the Civilian Magistrate have the authority to take away property for religious reasons? In the England of John Locke this was the case. Many a times the Civilian Magistrate enforced religious laws and confiscated property from those who were deemed to be infidels. Those who were deemed infidels depended on what was the dominant Religion of the State. As John Locke asks in his Essay on Toleration, what if there are two Churches in Constantinople? One of them is a Calvinist Church and the other is a Papist Church (Protestant and Catholic), does the Turk have a right to say who is right? Does the Turk just stand back? Does a Muslim National Leader have a right to save one of them from the other, or worst force them to convert by force of Arms? In effect, Locke concluded that the Civilian magistrate had absolutely no authority over Religious affairs, just as Religious leaders have no issue over civilian affairs. The Wall between the civil and religious world came to be from Locke’s and other philosophers of the time. They saw the threat to civil society in the religious wars of the era. This was a hundred year war was over the supremacy of the Catholic over the Protestant. There were no clear winners in these religious wars, but many millions died.
There is more to Locke’s argument. Those who decide to follow the true Church will be saved. But they will be saved only if they do follow their faith out of free will and not at sword point. Nobody who cannot or will not want to be saved can be saved. Hence the Civil Authority truly has no way of forcing anybody to believe in a particular Church, or confiscate goods of a worldly nature. From this idea Thomas Jefferson took the next leap of logic, as well as the Founding Fathers. There could not be any National Religion, since matters of faith are separate from matters of the State. They understood this intuitively, and as Free Masons, they also understood that the role of the citizen was separate from the role of the clergy, or he who attended Church. After all, Church was part of the Private Sphere, and not the Public Sphere… also known as Civil Life.
What has happened today? We have some in this country that now tell us that this is a Christian Nation. My fair reader, if this is a nation where faith is part of the private sphere and private life, how can our nation, a civil matter, be a Christian nation? Our founding Fathers understood this. Seems many of our current citizens have forgotten that grace and faith are private matters and cannot be forced into the Public Sphere.
Yes there are examples of how faith has “left” public life and prayer is a major rallying cry. One of them is Prayer in School. First off, prayer is a matter of the heart and belief. Second who’s prayer? If we are to understand the usual answer Christian prayer. Well then, what type of Christian prayer? Calvinist, Catholic, Southern Baptist? After all Catholics are not considered real Christians by many, and this is a serious problem. Moreover, if we are going to allow what is a private practice, that is Prayer, into school then we must allow ALL types of prayer.

My kind reader I have been remiss in coming back to this tale of our times. After all common sense tells us that we should have seen many Americans realize the threat to the Republic. Plubius does not make a business of endorsing those who seek public office, let alone those who seek the Presidency. Yet Plubius found a recent speech by one of the candidates especially candid.

The other day, while engaging I things that had nothing to do with this small space on the Internet, I had the opportunity to listen to General Wesley Clark on National Public Radio. Plubius makes his business to read widely and listen widely. Yet even Plubius, in this age of cynicism had to stop, raise the volume, and then go back to the website and listen to the speech once again.

The General, truly a Warrior-Scholar, spoke slowly and measurably of what ails the Republic. He spoke of many who told him that he had to run, as the Republic was in peril. He even spoke against the Empire that now seems to gush out of Washington. Plubius is familiar with the fall of the Roman Republic and the words used by the Warrior-Scholar reminded this listener of the last days of the Roman Republic, before Caesar rose and the Republic died at the steps of the Senate.

How appropriate, this listener had to say to himself, that one of our own Generals would be making this speech. After all, it was a Roman General who tried to save the Republic. Could our modern day Pompey be the clarion call for the Republic? Could his words, that he was called back from retirement from service to his country, be what we need to wake up the American Republic to the danger that now threatens her?

I do not know. But those initial ideas made me look into the ideas of our Warrior-Scholar and found them to be drawing from a deep pool of the American Enlightenment. Let me explain to my dear reader what I mean. Our people, are descendants of a rich tradition that many in this country seem to have forgotten. These are the ideas of the Enlightenment.

So let’s examine some of these ideas that were so radical two hundred and eighty four years ago.

These are Separation of Church and State, and the idea that the State will not establish any religion, as a State Religion. This does not mean, as some think that religion has no place in the life of the country. It does, but not in the sphere of government. This means that the government of the United States will not establish any Religion on the people, that includes Christianity. You are free to practice your faith, as much as I am, but neither of us has a right to say that our faith is superior to yours, or to bring it into the sphere of officialdom. Pray as much as you want, just not in public buildings. In fact, many of the invocations that our founding fathers were thinking of, were to a Rational God, in a rational Religion, not to a Christian God. It was a God that could properly be understood in the study of science and nature, because that was where it was to be found. It was not a god to be learned by rote, within the myths of religious writings, and for the most extreme of these views was Jefferson who believed that Christianity was a myth. Was Jefferson correct? I am not going to say yea or nay… it is not my place. What is true is that the God of the Enlightenment was not what many who would love to impose a Christian Taliban would recognize.

Let’s talk about other ideas that were revolutionary back then, and still are. One of those ideas are that we are a society with hope for all, and egalitarian ideals. Our society has made incredible strides towards this goal, ever so slowly. Our middle class is an American invention.

Now the most revolutionary of all ideas that came from the Enlightenment is that the government and the right to govern derives from the consent of the governed. This the Warrior-Scholar did state. Hence Plubius most ask, is our Warrior Scholar our modern day Cicero? And if he is our modern day Cicero, what does this tell us about the future of the Republic? After all, I would really be remiss if I did not tell you, dear reader, that Cicero was killed on orders of Caesar, as Caesar did succeed in creating the Roman Empire.

In the end, is our Warrior Scholar now a barometer to the death of the Republic? Will this be the last election of the Republic and will the Senate be disbanded and go home? Will they come back? The end of any Republic is messy, and we may as well be seeing this.
